TERMS OF SERVICE

By accessing or using Powder Realty (the “Service”) — at powderrealty.haus or via our iOS or Android apps — you agree to be bound by these Terms of Service. If you don't agree, don't use the Service.

Powder Realty is an aggregator of publicly available real estate listings in ski destinations worldwide. We link to original listings and provide search, mapping, comparison, and alert tools. We do not broker, facilitate, or participate in property transactions. We are not a licensed real estate agent, broker, or dealer in any jurisdiction.

Property listings, prices, descriptions, photos, and availability shown on Powder Realty are aggregated from third-party sources and may be incomplete, out of date, or incorrect. Always verify information against the original listing source before making any decisions. Currency conversions are estimates based on daily exchange rates and should not be used for transactional purposes.

Estimated rental yields, investment returns, and market trends shown on the Service are computed from public data using simplified models. They are not financial, tax, legal, or investment advice. Consult licensed professionals before making property decisions.

You agree not to:

• Scrape, crawl, or systematically download data from the Service without written consent
• Reverse engineer, decompile, or attempt to extract source code from our apps
• Use the Service to harass, spam, or defraud other users or property owners
• Circumvent rate limits, paywalls, or access controls
• Use the Service to build a competing product
• Violate any applicable law in connection with the Service

Price-drop and new-listing alerts require a valid email address. You are responsible for the email address you provide and for any consequences of unauthorized access to that inbox. You may unsubscribe from alerts at any time via the link in each email or by emailing us directly.

Certain features may require payment (“Pro” features). Fees, billing cycles, and refund terms will be clearly disclosed at the point of purchase. In-app purchases made through the Apple App Store or Google Play are subject to those platforms' refund policies, not ours.

The Powder Realty name, logo, app icon, interface design, code, and compiled data collections are our property and are protected by copyright and trademark law. Property photos and descriptions remain the property of their original source and are displayed under fair-use aggregation principles with attribution links to the source.

Property listings on Powder Realty link out to third-party sites including SUUMO, Homegate, Airbnb, and regional real estate portals. We are not responsible for the content, policies, or practices of those sites. Your interactions with them are governed by their own terms.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that data will be accurate.

To the maximum extent permitted by law, Powder Realty and its operators are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service, including but not limited to financial losses from property purchase or investment decisions. Our total liability for any claim will not exceed the greater of (a) $100 USD or (b) the amount you paid us in the 12 months before the claim.

You agree to indemnify and hold Powder Realty harmless from any claim arising from your violation of these Terms or your misuse of the Service.

We may suspend or terminate your access at any time for violation of these Terms or for any other reason at our sole discretion. You may stop using the Service at any time. The provisions of sections 3, 7, 9, 10, and 11 survive termination.

We may update these Terms from time to time. Material changes will be announced by email (if we have yours) or in-app. Continued use after a change means you accept the updated Terms.

These Terms are governed by the laws of the jurisdiction in which Powder Realty's operator is domiciled, without regard to conflict-of-laws principles. Disputes will be resolved in the courts of that jurisdiction unless required otherwise by applicable law.
